This comprehensive 2-hour course provides environmental professionals with a practical and well-supported framework for exercising professional judgment when remediating sites in New Jersey. Participants will examine the regulatory foundation established by the Site Remediation Reform Act (SRRA 2.0), recent policy direction from the New Jersey Site Remediation Professional Licensing Board, and compliance expectations of the New Jersey Department of Environmental Protection.

The program explores:

• The definition and limits of professional judgment and the applicable professional standard of care.

• The hierarchy of statute, regulation, and guidance — and when deviation is appropriate.

• The intersection of professional judgment and sound risk management practices

• Setting client expectations while operating in “risk management mode.”

• What constitutes malpractice in the remediation context.

• How to properly document the use of Professional Judgment during RI/RA/RAP phases.

• Variances from regulations, deviations from guidance, and reliance on other consultants’ work.

• Practical application through real-world case studies.
