Course Description:

This presentation aims to familiarize environmental professionals with the nuances of the NJDEP Technical Impracticability (TI) guidance, focusing on how to properly apply the principles of TI in a way that is consistent with both NJDEP regulations and LSRP ethics with outcomes that are protective of human health and the environment.

The presentation will review:

• development of the guidance document and its relationship to regulations;
• the obligations that a TI determination imposes on remediation activities at a site; and,
• the various steps leading to the conclusion of TI, including:
• NJDEP expectations for a TI submittal;
• LSRP expectations during a document inspection and review.

Actual case studies will be presented during the course to expand on the above topics.

• NY Professional Engineer & Geologist: 1.5 PDHs
• NJ Attorney:1.8 CLEs (Pending)*
